Attorney referrals in Belgrade, Serbia from Jun 23, 2015
Jasmina P. asked:
Hello,
In view of our recent discussion re making a will I've been seriously considering making one here in Serbia. I have a will in United States but doubt that it would suffice (court translated) here in Serbia. I do not have legal background so can anyone recommend a good attorney in Belgrade who can help me with that? Feel free to pm me if not comfortable sharing here. Thanks.
Mark D. answered:
I am no legal expert but just wanted to mention that a US will OUGHT to be valid here - it is an expression of the will of the deceased, and once translated/notarised is just as valid as any Serbian will, to the best of my knowledge. We completed all the inheritance business in Serbia with my father's UK will. The only thing of course is that the Serbian court has no jurisdiction over any assets in the US, UK or wherever, all it can rule on is the Serbian property.
Jasmina P. answered:
Thank you Mark. This is why I need a good attorney, so we can go through all this.
Ana S. answered:
Philomena O. answered:
Hi Ana, would you please be able to respond in English so everyone is able to understand (and share your info). Thank you!
Ana S. answered:
Sure Philomena, my apologies - basically anyone who wants to draft a will in Serbia, turn to your local Court house (Municipality Court House) - they can do it better and cheaper and deposit the will in the court house. No need for expensive and unreliable lawyers - of course not all are like that - and interaction with any family members....:-) - highly recommended!
Ana S. answered:
and lets hope the inheritance law (or whatever it is called) will be aligned soon with the EU regulations...
Sara A. answered:
would a Serbian will only be needed if actually a resident there? Otherwise wouldnt the US will be fine?
Jasmina P. answered:
That is one of the questions I needed an answer to. Per Ana's suggestion, I might find it in a local courthouse.
